The
following word shall carry the following meanings:
1) “Agreement” means the agreement for the carriage of vehicles         by Mzansi Car Carriers for and on behalf of the Customer.
2)  “Contract” means the Terms and Conditions hereof whether
        agreed to in writing or verbally between Mzansi Car       
        Carriers  and the Customer.
3) “Company” means Mzansi Car Carriers , the company that
        will perform services on behalf of the Customer.
4) “Customer” means the person who instructed Mzansi Car
       Carriers  to perform services on its behalf and/or any person
       who accepts an Mzansi Car Carriers quotation.
5) “Goods” means motor vehicles or any other type or description
       as described in the quotation.
6) “Parties” means Mzansi Car Carriers and the Customer
7) “Quotation” means the Quotation accepted by the Customer 
        in which Mzansi Car Carriers is appointed by the
        Customer to transport Goods on behalf of the Customer.
8) “Sub-Contractor” means any person with whom Mzansi Car
      Carriers  sub contracts to carry out Transportation.
9) “Transportation” means restricting the generality of this term,
       storing and/or safekeeping of any Goods.

Applicability of these Conditions 
The terms and conditions as contained herein together with any addendum thereto and the Quotation shall  govern the
relationship between Mzansi Car Carriers  and the Customer

1.1. All quotes are valid for 14 days.
1.2. The Company reserves the right to cancel any Quotation in
          circumstances where it becomes impracticable or
          uneconomical to carry out the Agreement and shall do so at
          the Company’s discretion. The Customer shall have no claim
          against the Company for any loss thereby incurred.
1.3. The Company reserves the right to revise any Quotations in
          the following circumstances:

1.3.1 In the event of the Company being obliged to obtain any 
             licenses or permits. 
1.3.2 In the event of the Customer and/or any third party
            increasing or changing the consignment. 
1.3.3 In the event the Company being obligated to deviate from
            the route selected as a result of adverse weather
            conditions, impassable or dangerous roads and bridges. 
1.3.4 In the event the Company being obliged to take out
            additional insurance cover.as envisaged in clause 2.4 below. 

2.1. Vehicles are transported on an open car carrier.
2.2 Transport services carried out in terms of the contract is done
         at the exclusive risk of the Customer.
2.3 The Company is not responsible for any loss and/or damages
         which the Customer may suffer as a result of the
         Transportation service rendered by the Company in terms of
          the Agreement.
2.4 If higher insurance cover is required for any particular load,
        the Customer shall inform the Company in writing as such
        before the Goods are up lifted for Transportation . An
        increase in the insurance cover will incur extra charges to
        for t he Customer account. 
2.5 The li ability of the Company f or any loss or damage to good 
         will not exceed the actual amount paid by the insurers.
2.6 The Customer shall inform the Company of any damages
         within 12 hours from the date of delivery. Mzansi Ca r
         Carriers can act  as an agent  for t he transport of y our 
         vehicle.
2.7 The Company will not accept liability for any personal effects          and loose articles placed in the vehicle for Transportation. 

2.8 The Company will not accept liability for mechanical failures
         and electrical defects that a vehicle may encounter whilst
         drive n on to or off t he vehicle transporter. 
2.9 Lead time s can take up t o 7  or  10  working days f rom time
          of  collection. This depends on space availability.

3.1.  Payment shall be received in full
          prior to the vehicle being loaded for transportation.

3.2. Where applicable, the Company is entitled to levy an interest
         charge against the Customer at the maximum rate permitted
         by the Credit Act which are outstanding and are unpaid by
         the Customer. 

3.3. Cancellations must be done in writing at least 48 hours prior
          to the agreed transportation date. Failure to do so will result
          in a 60% cancellation fee. 

4.1. The Customer will be required to complete a checklist prior
          to handing over the vehicle to the Company.
4.2. In the event of the checklist not being completed and signed,            the Customer shall be disentitled to claim for any damages of
         whatever nature arising.
4.3. All additionally fitted accessories to the vehicle (e.g.
         canopies, bull bars, roof racks) must be disclosed on the
         checklist.

The Customer shall:
5.1. Provide adequate loading and off- loading points.
5.2. Ensure that loading and off- loading at the points during the
         hours and days as agreed to by the parties

6.1. The Company has no authority to carry hazardous/illegal       
          goods and no such cargo may be loaded onto any of the     
          Company’s vehicles without written consent of the       
          Company.
6.2. Any claim for damages as a result of the carriage of
         hazardous and/or dangerous goods will be for
         the Customer’s account

7.1. Fuel level in the vehicles for transportation should be kept to
         a minimum to save weight.
7.2. Vehicles classified as a “Runner” must be able to start and
         drive without external assistance.
7.3. A “Non- Runner” vehicle may include accident damage, but
        must be able to roll on its own wheels. A vehicle with a flat
        battery is also considered a “non-runner”. Additional costs
        apply for non- runner vehicles.
7.4. Keys must always accompany the vehicle.
7.5. The Company may cede, delegate, assign or sub-contract any
         of its rights or obligations under this contract.
7.6. These conditions shall apply to any Transportation carried
         out on behalf of the Customer, whether or not the
         Customer’s attention has been drawn to these terms and
          conditions.
7.7. In the event of any dispute arising out of this agreement or
          the terms hereof, or the interpretation of the agreement, the
          laws of the republic of South Africa will apply
